1. Acceptance and Binding Agreement

These Terms of Service, together with our Privacy Policy and all referenced documentation, constitute a legally binding agreement between you (the visitor, bidder, or registered user) and PCSP. You affirm that you possess all necessary authority and capacity to enter into this agreement and fulfill its obligations. This agreement is as enforceable as any physically signed contract.

PCSP reserves the right to modify these terms at any time. Changes become effective immediately upon posting to the Platform. Your continued use following any modifications constitutes acceptance of the revised terms. We recommend reviewing these terms periodically to stay informed of any updates.

You may not use this Platform if you: (a) are under 18 years of age; (b) lack the legal capacity to form binding contracts; (c) have been suspended or banned from our services; or (d) fail to comply with payment or delivery obligations unless justified by our published policies.

2. Geographic Restrictions and Compliance

This Platform may not be accessible or appropriate for use in all jurisdictions. If your local laws prohibit participation in online auctions or similar commercial activities, you must not access or use this Platform. By proceeding, you explicitly confirm that you have verified the legality of your participation under applicable local, state, and federal regulations.

We make no guarantees regarding the availability or legality of materials or services offered through this Platform in any specific location. PCSP retains the right to restrict access to the Platform, or any portion thereof, based on geographic location, user type, or any other criteria at our sole discretion.

3. Privacy and Data Protection

PCSP is committed to protecting your personal information. Our comprehensive Privacy Policy outlines how we collect, process, store, and share user data. All data handling practices comply with applicable privacy laws and regulations.

We do not knowingly collect information from individuals under 13 years of age. This Platform is designed for adult users. If you are under 13, do not submit any personal information through this Platform.

4. User Accounts and Registration

Access to bidding features requires creation and maintenance of a user account ("Account"). During registration, you must provide accurate information including your name, email address, password, and business or residential address. This information enables us to:

• Verify your eligibility to participate in auctions
• Ensure account uniqueness and prevent fraud
• Implement appropriate security measures
• Provide technical support and resolve disputes
• Communicate important auction-related information

You agree to maintain accurate, current, and complete account information at all times. Providing false or misleading information may result in immediate account termination and potential legal action.

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE SECURITY AND CONFIDENTIALITY OF YOUR ACCOUNT CREDENTIALS. All activities conducted through your account are your responsibility, regardless of whether you authorized them.

You must immediately notify us of any unauthorized access, security breach, or suspicious activity related to your account. PCSP bears no liability for losses resulting from unauthorized account use, whether or not you were aware of such use.

5. User Conduct and Prohibited Activities

All users must conduct themselves professionally and legally while using this Platform. You are solely responsible for your communications and interactions with other users. Specifically, you agree not to:

• Attempt unauthorized access to restricted areas of the Platform
• Use automated tools, bots, or scripts to manipulate bidding processes
• Post false, misleading, or defamatory content
• Violate intellectual property rights of PCSP or third parties
• Engage in fraudulent bidding, shill bidding, or price manipulation
• Harass, threaten, or abuse other users
• Interfere with Platform security or attempt to access other users' accounts

PCSP may immediately suspend or terminate accounts suspected of policy violations. We reserve the right to investigate suspicious activity and cooperate with law enforcement authorities when appropriate.

6. Auction Participation and Obligations

When you place a bid, you enter into a legally binding commitment to purchase the item if you are the winning bidder. All bids are final and cannot be retracted except in cases explicitly allowed by our auction policies (such as seller material misrepresentation or clear typographical errors).

Buyer Obligations: Winning bidders must complete payment within the timeframe specified in the auction listing. Failure to pay may result in account suspension, forfeiture of security deposits, and loss of bidding privileges.

Seller Obligations: If you list items for auction, you must deliver all sold items as described. Material misrepresentation or failure to deliver may result in account termination and financial penalties.

7. Product Listings and Accuracy

Each seller is responsible for the accuracy and completeness of their product listings. PCSP does not verify or guarantee the accuracy of seller-provided information. We update Platform content regularly but cannot guarantee complete accuracy or currency of all information.

Buyers are responsible for thoroughly reviewing listings, including descriptions, conditions, specifications, and photos, before placing bids. Contact the seller or PCSP support if you need clarification before bidding.

8. Returns and Refunds

Return eligibility depends on whether the product was sold by PCSP directly or by a third-party seller:

To initiate a return, you must obtain a Return Merchandise Authorization (RMA) number before shipping items back. Returns without a valid RMA may be refused. The RMA number must be clearly visible on all return packages. Returned items must be in original packaging and resalable condition.

Buyers are responsible for return shipping costs unless the return is due to PCSP error. A restocking fee may apply to certain returns. Credit for approved returns is issued according to our current return processing guidelines.

9. Shipping & Offers

Winning bidder is responsible for all shipping costs. Landed-cost offers are not accepted.

10. Platform Availability and Modifications

While we strive for continuous uptime, we cannot guarantee uninterrupted Platform availability. PCSP reserves the right to modify, suspend, or discontinue any Platform features or services at any time, with or without notice, for maintenance, upgrades, or any other reason.

No refunds or compensation will be provided for Platform downtime or service interruptions. We are not liable for any losses resulting from Platform unavailability.

11. Intellectual Property Rights

All content, design elements, logos, trademarks, graphics, text, software, and other materials on this Platform ("Platform Materials") are owned by PCSP or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal or business auction participation only. You may not:

• Copy, reproduce, distribute, or create derivative works from Platform Materials
• Reverse engineer, decompile, or disassemble any Platform software
• Use PCSP trademarks, logos, or branding without written permission
• Frame or embed Platform content on other websites
• Extract or harvest data through automated means

12. User-Generated Content

You may submit content such as product listings, reviews, comments, photos, and messages ("User Content") through this Platform. By submitting User Content, you grant PCSP a perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, publish, and distribute your User Content for any purpose related to Platform operations.

You represent and warrant that:

• You own or have necessary rights to all User Content you submit
• Your User Content does not violate any laws or third-party rights
• Your User Content is accurate and not misleading
• You have obtained all necessary consents for any personal information included

You are solely responsible for your User Content. PCSP does not endorse or guarantee the accuracy of User Content and is not liable for any losses arising from User Content.

This Platform may contain links to third-party websites, services, or resources for your convenience. PCSP does not endorse, control, or assume responsibility for any third-party content or practices. These Terms of Service do not apply to third-party websites. We recommend reviewing the terms and privacy policies of any third-party sites you visit.

Some jurisdictions do not allow limitation of liability for consequential damages, so these limitations may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless PCSP, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms of Service; (b) your User Content; (c) your use or misuse of the Platform; (d) your violation of any laws or third-party rights; or (e) your auction transactions with other users.

17. Security and Technical Issues

Due to the nature of internet communications, technical issues may occasionally cause inaccurate or incomplete information display. Computer viruses or malicious software may be inadvertently transmitted through file sharing or downloads.

PCSP is not responsible for any damage to your computer equipment, software, data, or other property resulting from Platform access or use. We strongly recommend maintaining up-to-date antivirus and security software.

18. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Ohio, United States of America, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Franklin County, Ohio. You consent to the personal jurisdiction of these courts and waive any objections regarding venue or inconvenient forum.

19. Account Investigation and Termination

To maintain Platform integrity and user safety, PCSP may investigate accounts suspected of violating these Terms or engaging in fraudulent activity. You authorize us to access your account and related records during such investigations.

We reserve the right to suspend or terminate accounts immediately, without prior notice, if we believe terms have been violated or fraudulent activity has occurred. Account termination may result in forfeiture of funds or deposits where permitted by law.

20. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the complete agreement between you and PCSP regarding Platform use and supersede all prior agreements.

Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver: PCSP's failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not transfer or assign these Terms without our written consent. PCSP may freely assign these Terms without restriction.
